Terms and Conditions of Sale

I. General Provisions

1. Scope

These general terms and conditions of sale (GTC) aim to define the conditions under which the products of your online store are sold to consumers. They apply to all sales concluded by your company and govern the contractual relationship between you and your customers.

In these GTC, the following terms shall have the meaning ascribed to them below:

Your company reserves the right to modify these GTC at any time. The applicable GTC are those in effect at the time of the customer's order. Therefore, the customer is invited to consult them regularly.

II. Products and Prices

The online store offers a range of fitness products designed to help customers achieve their fitness goals. The descriptions of each product are detailed on the product page, including features, dimensions, and functions.

2. Product Availability

Product availability may vary depending on demand and stock availability. The store strives to keep the product availability information up to date on the website but cannot guarantee the availability of all products at all times.

3. Product Prices

Product prices are indicated in US dollars (USD) and include all applicable taxes. Delivery fees are not included in the product price and will be charged separately.

IV. Payment

V. Delivery

Delivery times vary depending on the geographical area and chosen delivery method. The average delivery time is 9 business days for orders destined to the United States and the United Kingdom. However, these timeframes are provided for reference only and are not guaranteed. In case of delivery delays, the customer will be notified by email.

We deliver our products to the United States and the United Kingdom. The eligible countries for delivery will be specified during the ordering process.

3. Delivery Methods

We utilize several delivery service providers to ensure the delivery of our products. The available delivery methods depend on the geographical area and the weight of the order. The available delivery options will be indicated during the ordering process.

4. Delivery Fees

Delivery fees depend on the geographical area, the weight of the order, and the chosen delivery method. The delivery fees will be indicated during the ordering process, and the customer must confirm them before proceeding with the payment.

VI. Right of Withdrawal and Returns

1. Withdrawal Period

The customer has a period of seven (7) days from the receipt of their order to exercise their right of withdrawal, without having to provide any justification or incur any penalties.

2. Exclusions from the Right of Withdrawal

The right of withdrawal does not apply to contracts for the supply of goods made to the customer's specifications or clearly personalized, perishable goods, as well as to products that have been opened, used, or damaged by the customer.

3. Return Procedure

The customer must inform the store of their decision to withdraw by sending an email or filling out a withdrawal form on the website. They must then return the products to the store within seven (7) days following the communication of their decision to withdraw, in their original packaging and in good condition. The return costs are borne by the customer.

4. Refund

The store commits to refunding the customer within fourteen (14) days from the receipt of the returned products, using the same payment method used during the order. The refund will include the price of the products as well as the initial delivery fees, excluding the return costs.

VII. Warranties

1. Legal Warranties

a) Warranty of Conformity

In accordance with the applicable laws, the Customer benefits from legal warranties of conformity for the purchased products. The Customer has a period of two years from the delivery of the product to exercise the warranty of conformity. They can choose between product repair or replacement, subject to the cost conditions provided for in Article L. 217-9 of the Consumer Code.

b) Warranty of Hidden Defects

The Customer also benefits from the warranty of hidden defects for the purchased products. The Customer has a period of two years from the discovery of the defect to exercise the warranty of hidden defects. In this case, they can choose between canceling the sale or reducing the sale price in accordance with Article 1644 of the Civil Code.

2. Commercial Warranties

In addition to the legal warranties of conformity and hidden defects, certain products may benefit from a commercial warranty. The details of this warranty, including its duration and territorial scope, are specified in the corresponding product sheet. The commercial warranty does not affect the legal warranties of conformity and hidden defects.

VIII. Liability

1. Seller's Liability

The seller is responsible for the conformity of the products sold with the applicable laws and regulations. They also commit to delivering products that are in accordance with the descriptions provided on the website and adequately packaged to prevent any damage during transport. In case of non-conformity of a product, the seller undertakes to replace it or refund it, in accordance with the applicable legal and commercial warranties. The seller cannot be held liable for direct or indirect damages caused by the use of the products sold, except in case of proven fault on their part.

2. Buyer's Liability

The buyer is responsible for the use of the products purchased on the seller's website. They are specifically required to comply with the instructions for use and safety provided with the products. The buyer is responsible for verifying the compatibility of the products with their needs and equipment before placing an order. The seller cannot be held responsible in case of incompatibility. In case of the buyer's fault, particularly in case of misuse or failure to comply with the instructions for use and safety, the seller cannot be held liable for direct or indirect damages suffered by the buyer or a third party.

IX. Personal Data

1. Collection and Use of Personal Data

The seller undertakes to collect and process the personal data of users in accordance with the applicable regulations regarding the protection of personal data. The personal data collected may include, but is not limited to, name, address, email address, phone number, payment information, website browsing data, user preferences, etc. The seller agrees to process the collected personal data only within the scope of the contractual relationship between the seller and the buyer.

2. Users' Rights Regarding Their Personal Data

In accordance with the applicable regulations regarding the protection of personal data, users have the right to access, rectify, object to, and delete their personal data. Users can exercise their rights by sending a written request to the seller at the address provided in these terms and conditions of sale. The seller undertakes to respond to any requests regarding the exercise of users' rights within a reasonable period.

X. Disputes and Complaints

1. Mediation

In the event of a dispute, the buyer is encouraged to first contact the customer service of the store in order to find an amicable solution to the dispute. If no amicable solution is found, the parties agree to attempt mediation before resorting to the competent court.

2. Jurisdiction

Any dispute arising from the application or interpretation of these general terms and conditions of sale shall be subject to the jurisdiction of the competent court in the location of the seller's headquarters. In the event of a dispute, the parties undertake to make every effort to find an amicable solution before resorting to the competent jurisdiction. The law applicable to these general terms and conditions of sale is the law of the United Kingdom.

XI. Final Provisions

1. Applicable Law

These Terms and Conditions of Sale are subject to the law of the United Kingdom.

2. Nullity

If any provision of these Terms and Conditions of Sale is deemed null or unenforceable under a law, regulation, or court decision, it will not affect the validity of the other provisions.

3. Contract Language

These Terms and Conditions of Sale are written in English. In the event of a translation into another language, the English version shall prevail in case of any dispute.

4. Modification of the Terms and Conditions

The seller reserves the right to modify these Terms and Conditions of Sale at any time. The applicable Terms and Conditions are those in effect at the time of placing the order. Changes to the Terms and Conditions are binding on the users of the website from the date of their publication and cannot be applied to transactions concluded prior to that date.
